"Although the latter (Yevgeny Prigozhin) is liable for actions which have undermined the territorial integrity, sovereignty and independence of Ukraine, Ms. Prigozhina's hyperlink along with her son, which was established on the time of the adoption of the restrictive measures, is predicated solely on their relationship, and is subsequently not adequate to justify her inclusion within the restrictive measures," the Basic Court docket stated in its ruling.

"As well as, the Council (of the European Union) fails to exhibit that she owned different undertakings with hyperlinks to her son on the date of the adoption of the contested acts."

"Consequently, the hyperlink that may quantity to an affiliation between the 2 individuals established on the time of the adoption of the contested acts and upon which the Council relied on that date is predicated solely on their household relationship, which, in view of the criterion utilized by the Council within the current case, the assertion of causes on which the contested acts are based mostly and the case-law of the Court docket of Justice, will not be adequate to justify her inclusion on the contested lists," it added.

The Council of the European Union has two months to attraction the choice.
